Understanding Eligibility

Eligibility for the Disability Tax Credit (DTC) isn’t based solely on a diagnosis. It depends on how significantly your day-to-day functioning is affected all or most of the time. You may qualify if you experience ongoing difficulty or require assistance with one or more of the following Basic Activities of Daily Living (BADLs):

  • Walking – Difficulty walking short distances, needing frequent breaks, using mobility aids, or requiring assistance from another person

  • Feeding – Challenges preparing food, cutting or lifting items, bringing food to your mouth, or taking significantly longer to eat

  • Dressing – Difficulty putting on or removing clothing, fastening buttons or zippers, or needing help due to pain, stiffness, or coordination issues

  • Speaking – Being unable to speak clearly, being understood only with effort, or experiencing speech disorders that limit effective communication

  • Hearing – Difficulty hearing conversations even with hearing aids, relying on lip-reading, or needing repetition to understand speech

  • Eliminating (using the toilet) – Needing frequent bathroom access, experiencing incontinence, or requiring assistance with toileting

  • Mental Functions – Significant challenges with memory, attention, judgment, emotional regulation, or daily decision-making (e.g., ADHD, anxiety, depression, brain injury)

  • Life-Sustaining Therapy – Requiring ongoing therapy to support a vital function, such as insulin therapy, dialysis, oxygen therapy, or chest physiotherapy

Eligibility considers whether these limitations are present almost all of the time, even with treatment, medication, or assistive devices.
